New York regulators are considering new rules that could require sports betting app users to verify their identity with biometrics, as the state steps up efforts to curb underage gambling and strengthen consumer protections.
Draft regulations under review by the New York State Gaming Commission would allow operators to require biometric confirmation both when users create accounts and before they place wagers. The proposal follows a push by Kathy Hochul, who has called for stronger safeguards as mobile sports betting becomes more widespread and accessible.
The measures are aimed primarily at preventing minors from opening betting accounts or accessing accounts registered to adults. Officials are exploring technologies such as facial recognition as part of a broader review of age assurance tools, while also considering other risk-monitoring mechanisms for problematic gambling behavior.
The proposal has also reignited debate around privacy and proportionality. Civil liberties advocates have questioned whether requiring biometric checks for every wager could expand the routine collection of sensitive personal data beyond what is necessary for age verification.
New York remains the largest online sports betting market in the US, which means any move toward biometric verification could carry influence well beyond the state. The draft rules are currently open for public comment before regulators decide whether to finalize them.
